There are certain things you will need to gather together immediately before starting the divorce process in Nebraska. Either you or your attorney will need these to file the necessary documents with the court. There are three confidential documents that need to be filed with any divorce. These are the Social Security Number, Gender, and Date of Birth form, Confidential information form, and the Department of Health and Human Services Vital Records form. Some of this information will also go in the Complaint for Dissolution of Marriage, which is the filing required by the Courts to start a divorce case. When meeting with an attorney, if you have these things with you, they will be able to get the proper documents drafted and officially start the dissolution of marriage process much more quickly. While tax returns and paystubs are great to have as soon as possible, these are the things you will need right up front:
- If there are children involved, it is best to have their dates of birth and social security numbers.
- Where your children have lived for the past 5 years, included addresses and for how long (i.e. 123 Main Street, Town, County, Nebraska from May 2015 to August 2020).
- Your spouse’s social security number and date of birth;
- Your social security number and date of birth;
- Your place of birth and your spouse’s place of birth
- You or your spouse’s maiden name;
- Date, time, and place where your marriage took place; and
- Your current address and your spouse’s current address or an address to locate them.
While every attorney might vary from this list, this is basically what everyone would need at the very least. The confidential documents are exactly that, confidential. Courts need the information but it is by no means in the public record like other filings are. This may vary for other states as well in what they may need for their filings.
